Les Morts (72997185S), in compliance with current regulations on personal data protection, informs that personal data collected through the forms on the website: www.lesmorts.es, are included in specific automated files of users of Les Morts services.
The collection and automated processing of personal data are intended to maintain the commercial relationship and perform information, training, advisory tasks, and other activities typical of Les Morts. These data will only be transferred to entities necessary to fulfil the aforementioned purposes. Les Morts adopts the necessary measures to ensure the security, integrity, and confidentiality of data in accordance with Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016, concerning the protection of natural persons regarding the processing of personal data and the free movement of such data.

What is the purpose of processing your personal data?
At Les Morts, we will process your personal data collected through the Website: www.lesmorts.es, for the following purposes:
• If you contract the goods and services offered through www.lesmorts.es, to maintain the contractual relationship, as well as the management, administration, information, provision, and improvement of the service.
• To send the information requested through the forms available on www.lesmorts.es
• To send newsletters and commercial communications about Les Morts promotions and/or advertising in the sector.
You can object to receiving commercial communications by any means at any time by sending an email to the address indicated above. The fields in these records are mandatory, and it will be impossible to carry out the stated purposes if these data are not provided.
How long are the collected personal data retained?
Personal data provided will be kept while the commercial relationship is maintained or until you request its deletion and for the period during which legal liabilities may arise from the services provided.
Legitimacy:

If the user includes files with personal data on shared hosting servers, Les Morts is not responsible for the user’s breach of GDPR.
Data retention in compliance with the LSSI:
Les Morts informs that, as a data hosting service provider and under the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), it retains the essential information to identify the origin of the hosted data and the time the service was provided, for a maximum of 12 months. Retaining these data does not affect the secrecy of communications and can only be used within the framework of a criminal investigation or for public security purposes, being made available to the judges and/or courts or the Ministry that requires them.
Communication of data to State Security Forces and Bodies will be made under the provisions of personal data protection regulations.
Intellectual Property Rights of Les Morts:
Les Morts owns all copyright, intellectual property, industrial property, “know-how,” and any other rights related to the website content www.lesmorts.es and the services offered on it, as well as the necessary software for its implementation and related information. Reproduction, publication, and/or use not strictly private of the total or partial contents of the website www.lesmorts.es are not permitted without prior written consent.
Intellectual Property of Software:
The user must respect the third-party programs made available by Les Morts, even if they are free and/or publicly available.
Les Morts has the necessary exploitation and intellectual property rights of the software. The user does not acquire any rights or licenses for the contracted service on the software necessary for service provision, nor on the technical monitoring information of the service, except for the rights and licenses necessary to comply with the contracted services and only for the duration thereof.
For any action that exceeds the contract’s compliance, the user will need written authorisation from Les Morts. It is forbidden for the user to access, modify, view the configuration, structure, and files of the servers owned by Les Morts, assuming civil and criminal liability arising from any incident that could occur in the servers and security systems as a direct result of negligent or malicious action.
Intellectual Property of Hosted Content:
Using services provided by Les Morts contrary to intellectual property legislation is prohibited, specifically:
• Any use that is contrary to Spanish laws or infringes third-party rights.
• The publication or transmission of any content deemed violent, obscene, abusive, illegal, racist, xenophobic, or defamatory by Les Morts.
• The use of cracks, software serial numbers, or any other content that infringes third-party intellectual property rights.
• The collection and/or use of personal data of other users without their express consent or contrary to the provisions of Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016.
• The use of the domain’s mail server and email addresses to send unwanted bulk emails.
The user is fully responsible for the content of their website, the information transmitted and stored, hyperlinks, third-party claims, and legal actions concerning intellectual property, third-party rights, and child protection.
The user is responsible for complying with current laws and regulations and rules relating to the operation of the online service, e-commerce, copyright, maintenance of public order, and universal principles of internet use. The user will indemnify Les Morts for expenses generated by the implication of www.lesmorts.es in any case attributable to the user, including legal fees and defence costs, even in the case of a non-final court decision.
Protection of Hosted Information:
Les Morts makes backup copies of the content hosted on its servers but is not responsible for accidental loss or deletion of data by users. Similarly, it does not guarantee the full replacement of deleted data by users, as these data could have been deleted and/or modified during the period since the last backup. Services offered, except for specific backup services, do not include the replacement of content retained in the backup copies made by Les Morts when this loss is attributable to the user. In this case, a fee will be determined based on the complexity and volume of recovery, always with prior acceptance by the user.
The replacement of deleted data is only included in the service price when the content loss is due to causes attributable to Les Morts.
Commercial Communications:
In application of the LSSI, Les Morts will not send advertising or promotional communications by email or other equivalent electronic means that have not been previously requested or expressly authorised by the recipients.
In the case of users with whom there is a prior contractual relationship, Les Morts is authorised to send commercial communications relating to products or services of Les Morts that are similar to those initially contracted with the customer.
In any case, the user, upon proving their identity, may request that no more commercial information be sent through the Customer Service channels.
